seeks an individual to join the

Montana University System (MUS)

legal team in providing preventative and responsive advice on legal matters for The University of Montana and its affiliated campuses, as well as to the system as part of the Montana University System legal team. This is a full-time contract position, renewable annually in accordance with Board of Regents personnel policies. Description of Work Unit:
The six-member legal staff, of which two are located on the Montana State University campus in Bozeman and two are located on The University of Montana campus in Missoula, report to the Chief Legal Counsel located in Helena. The work of this campus counsel is dedicated primarily to the University of Montana-Missoula and its affiliated campuses. UM Legal Counsel will collaborate on a daily basis with the UM president, chancellors, administrators and staff to provide advice and guidance on the legal matters related to the operation of the campuses and the provision of educational services to students.

Duties and Responsibilities:
The successful candidate will perform a wide range of legal duties, provide legal advice to the UM president and UM staff, manage all legal services for the university, and work as part of a system-wide legal team under the oversight of the Commissioner of Higher Education. The following constitute examples of the legal duties of this position:

Provides leadership, strategic direction and analysis for the University’s legal function to achieve the mission of the University in compliance with Board of Regents’ policies and directives, applicable policies, and state and federal law.

Acts as confidential advisor/counsel to the Board of Regents, President, chancellors, and senior managers in advising on the legal impact of strategic issues.

Represents the University in all legal matters and manages University responses to litigation, legal investigations and other legal proceedings; ensures appropriate legal representation on all UM affiliated campuses and at all designated organizational levels.

Advises University administrators on matters involving legal interpretation and decisions related to University activities, policy, and operations.

Ensures the University operates within the appropriate legal governance framework; assists in the identification and management of all legal risks across the University.

Handles legal problems and potential disputes for the University and its affiliated campuses and makes recommendations on legal matters, as needed or as assigned.

Confers and advises University administrators, employees and student organizations on matters of concern, disputes or complaints necessitating legal interpretation and resolution related to all aspects of University operations.

Participates in campus collective bargaining and management of labor grievances.

Drafts contracts, policies, agreements, and other legal documents as needed for compliance with state and federal law and Board of Regents’ and University policies.

Serves on University committees as designated by the President; attends Board of Regents’ meetings and participates in system-wide meetings as requested.

Provides workshops, seminars or training sessions for UM and affiliated campuses regarding legal issues in higher education.

Provides advice to the commissioner and president on pending legislation that could impact University operations, programs or activities; recommends operational changes necessitated by legislative mandates.

Develops and amends policies and procedures to enable the University to accomplish its objectives.

Performs specific legal work as assigned by the Chief Legal Counsel and/or Commissioner of Higher Education.

Oversees compliance and intellectual property management functions of the University.

Performs other related duties as needed or as assigned by the president.

Experience Required:
Receipt of a Juris Doctorate degree from an ABA-accredited law school.

Licensed to practice law in the State of Montana and be in good standing, or be eligible to obtain licensure promptly after hiring.

Legal experience, preferably including litigation, public administration, and employment law experience, with 10 years significant and progressive experience preferred.

Record of responsibility working with top level management in public or private enterprises; experience with public agencies preferred, including knowledge of public operations and familiarity with government regulatory compliance and oversight.

Demonstrated professional stature, competence and confidence to operate with credibility at the executive level, as well as demonstrated professional history of maintaining objectivity while driving appropriate outcomes, managing multiple stake-holder agendas, and promoting high client service standards.

Ability to rapidly prioritize many conflicting demands and projects, as well as to execute, while exhibiting integrity and sound judgment.

Demonstrated ability to manage and supervise attorneys and litigation.

Strong analytical, research and problem-solving skills.

Demonstrated ability to perform well as part of a team of professionals confronting change and increased service expectations in a highly visible organization.

Ability to work collegially and effectively with a diverse group of constituents, including the Board of Regents, President, executive officers, deans, directors and department heads, external groups, faculty, staff and students.

Ability to contribute as an executive officer to the leadership of the University in matters of policy, planning and risk management.

Understanding of and ability to work effectively within an academic environment.

Willingness and capability to handle crisis and public relations matters.

Excellent interpersonal skills.

Must be literate in standard communications technologies.
