Duties:
This is a senior level attorney position in the Civil Services Bureau. T! he incumbent serves as the primary point of contact on water law and Indian law matters. The incumbent independently handles all phases of complex civil litigation in Montana water court, state district courts, the Montana Supreme Court, United States District Courts and Courts of Appeal, and the United States Supreme Court. These are high-profile cases, often involving complex hydrologic evidence or multiple sovereigns (i.e., tribal and state relations, or state to state relations and state and federal relations). To accomplish this litigation, the incumbent may oversee a team of attorneys and support staff in complex litigation involving water and in the completion of other major projects dealing with water law or water policy issues. The incumbent oversees case development and trial presentation phases in cases involving junior attorneys. The incumbent is the Attorney General’s principal advisor with respect to Water and Indian law and policy matters, and is the princi! pal attorney contact for courts, federal, tribal, state and local offic! ials, and the public in such matters.

This position represents the State in matters of tribal sovereign relations and jurisdiction. The Attorney also participates in national legal projects and litigation at the Courts of Appeal and the United States Supreme Court, sometimes in cooperation with the National Association of Attorneys General and the Conference of Western Attorneys General.

Serves as counsel to the Attorney General and Department of Justice, drafts letters of advice and formal legal opinions for the review and signature of the Attorney General. Subject matter concerns, without limitation, the interpretation and application of statutes, rules and regulations and federal laws regarding water and Indian law issues.

Education/Experience:
These knowledge, skills and abilities are generally acquired through:

Graduation from college and an accredited law school.

Must be licensed to practice law in Montana (as certified by the Montana Supreme Court) and hold membership in good standing with the State Bar of Montana OR be licensed to practice law in any state with membership in good standing in that state’s bar association and be able to become licensed to practice law in Montana within an established time period determined at time of hire.

Plus five or more years of job-related work experience.

Two years of experien! ce in Indian law and water law “preferred.”
