Duties:
This position conducts advanced legal research and investigation into state and federal administrative rules, statutory and case law, practices of other states, and local government and public concerns to provide comprehensive professional legal support, direction, and advice for the Department of Commerce as a whole. This includes research and investigation into areas of state and federal law; providing advice on issues that have major impacts on agency operations; monitoring and responding to legislative and other initiatives that have potential to impact program operations; and developing and coordinating the implementation of proposed administrative rules and legislation. This position performs legal and administrative work related to representing the department and its constituent’s interests related to any issue under the mission of the department. This position assists the Chief Legal Counsel investigate, prepare and conduct trials, administrative hearings, and settlement negotiations to represent the State of Montana in cases involving the department’s functions in administrative hearings and state and federal courts. This involves developing approaches for complex and novel circumstances; considerable research, interpretation and construction of legal issues; filing formal complaints; and seeking injunctions and restraining orders if necessary. This involves preparing informational materials; responding to inquiries from the public, department staff, regulated businesses, and other affected parties; and preparing and delivering presentations regarding legal aspects of the Department’s programs.

Knowledge:
The position requires extensive knowledge of the concepts and theories of the legal profession including administrative law; case law; court rulings; Montana Rules of Evidence and Civil Procedure; constitutional law; criminal law; and the basic rules, customs and practices in other states and foreign countries having persuasive authority in Montana courts. The position requires thorough knowledge of local court rules, individual customs and procedures for each of Montana’s twenty-one judicial districts, federal district courts, and state appellate courts. Extensive knowledge of both state and federal legislative processes, drafting and lobbying including considerable knowledge of drafting legislation packages, providing legislative testimony, and the creation of administrative rules under the Montana Administrative Procedures Act. The position also requires knowledge of Department of Commerce and State personnel procedures and policies, employment law, program requirements, employee relations, and personnel management practices and techniques.

The position requires knowledge of the application of law to a broad range of areas including local government technical assistance, economic and community development, tourism promotion, housing and health facility financing programs, grant and loan programs, employment and contract law, accounting and tax law, etc.

Skills:
The position requires skill in the use of a personal computer and the Internet. The position requires skill in assigning, reviewing and organizing work; developing policies and procedures; and in supervising others. Good legal writing skills are required.

The position also requires skill in leadership; program planning and implementation; mediation; and research and analysis. This position also requires skill in the operation of a personal computer and typical business applications (e.g., word processing, spreadsheets, databases) and in the operation of a motor vehicle.

Abilities:
The position requires the ability to assess complex issues and determine their impacts; communicate effectively; develop approaches to sensitive issues that have significant economic impacts on the state; remain calm and professional, and respond articulately under pressure; coordinate major cases for trial; practice before state and federal courts; plan legal strategy; analyze and interpret legal documents and information to make sound judgments; conduct research into diverse areas of law; interpret and apply statutes, codes, case law and precedents to assigned legal problems; establish and maintain effective working relationships with staff, other agencies, the public, attorneys and judges; and to serve as an advocate in formal cases.

Education/Experience:
The education and experience REQUIRED for this position is a Juris Doctorate degree from an ABA accredited law school, admittance to practice before the Montana Supreme Court and the United States Federal Court for the District of Montana and 4 or more years of experience practicing law.
