Duties:
Represents Indigent Criminal Defendants who have been convicted of felony offenses, and who wish to challenge the conviction and/or sentence by presenting an appeal to the Montana Supreme Court: Reviews lower court proceedings, including the district court record and transcripts, establishes a case strategy by a creating of time line, a statement of case and a statement of facts of the case. Conducts manual and computerized legal research for potential legal issues and writes a legal brief in which the applicable facts and legal issues are presented fo! r resolution by the Montana Supreme Court. Drafts defense pleadings and all appropriate motions necessary for perfecting an appeal, obtaining a transcript, and pursuing the appeal, including Notices of Appeal, Petitions to Proceed in Forma Pauperis, Petitions for Transcripts, Motions for Extensions of Time, Stipulations, Motions to Strike, and Motions to Reconsider and Petitions for Rehearing. Upon notification that the Montana Supreme Court has set a case to be argued orally before the Court, review all facts of the case, all procedural matters, and the beliefs filed by the parties, conduct additional research to determine if recent cases affect the issues raised, prepare a theory or presentation for the argument in front of peers, and present oral argument on behalf of the client, and in rebuttal to the states argument, before the Montana Supreme Court. Provide legal advice to clients regarding the appeal and related matters, including the options available in the state c! ourt and federal court systems. The attorney must maintain sufficient c! ontact with the client, which will necessitate visits to the Montana State Prison in Deer Lodge, Shelby , Great Falls , Missoula and Glendive, the Womens Correctional Center in Billings , county jails, and pre-release centers throughout the state. Represent indigent criminal defendants who have been convicted of felony offenses, and who wish to challenge the conviction and/or sentence in post-conviction relief proceedings if they have exhausted the right to appeal, or otherwise were unable to present an appeal. Respond to inquiries and from attorneys and district court judges regarding indigent defense. Advise attorneys representing indigent defendants in Montana regarding procedural and substantive questions regarding appeals, post-conviction petitions and writs of habeas corpus.
Competencies:
Position requires knowledge of the skills required to represent individual indigent criminal defendants on appeal; knowledge of the techniques involved in manual ! and computerized legal research; preparation, writing, citation and documentation of motions, briefs, and other legal documents according to the Montana Uniform District Court Rules, the Montana Rules of Appellate Procedure, and state statutes. Knowledge of the concepts, theories, principles, and practices of criminal law, criminal procedure, and the state and federal court systems, which include knowledge of criminal law and procedure, pursuant to the state criminal codes and federal laws, state and federal constitutional law, the Montana Rules of Civil and Appellate Procedure, Federal Rules of Civil, Criminal, and Appellate Procedure, Uniform District Court Rules and local rules; and Federal and Montana Rules of Evidence. Acts with good judgment in representing clients, in dealing with opposing counsel, and in addressing the courts; deals with confidential and sensitive data concerning the client?s case, and maintaining the attorney client privilege. Must have the ability! to establish and maintain effective working relationships with the pub! lic, elected officials, defendants, witnesses, Judges, court personnel, law enforcement personnel employees, judges, other agencies and the public. Must have organizational skills; ability to provide strong leadership and direction; ability to recognize, analyze and solve complex problems; deal effectively with highly sensitive public, political and agency specific issues; assess hypothetical situations and impacts; consolidate a unified strategy in response to numerous issues and concerns; make proper decisions in stressful situations.
Education/Experience:
The minimum requirements include a Juris Doctor from ABA accredited law school. Ideal candidates must have a strong desire to work in the Public Defender System and have at least three years of practical experience in law, preferably in litigation of criminal and civil law involving public defense actions. Admission to the State Bar of Montana is preferred on date of hire.
