Special Information:
The Office of the Appellate Defender (OAD) represents clients before the Montana Supreme Court and other appellate courts, including the United States Supreme Court. When appointed, OAD provides appellate representation in criminal, juvenile, dependent and neglect, and involuntary commitment cases. OADâs mission is to provide independent, effective, high-quality representation to the indigent individuals it is appointed to represent. In the spirit of Gideon, we strive âto bring to life . . . the dream of a vast diverse country in which every person charged with a crime will be capably defended, no matter what his economic ! circumstances.â An 11 member Public Defender Commission oversees OAD. The Public Defender Commission appoints the Chief Appellate Defender. Wade Zolynski is the current Chief Appellate Defender. He supervises OADâs team of Assistant Appellate Defenders and Administrative Support Staff. OAD is a statewide office headquartered in Helena, Montana with cases originating in every corner of Montana.
Duties:
An Assistant Appellate Defender represents indigent clients in appellate matters before the Montana Supreme Court and other courts of appeal, including the United States Supreme Court. Responsibilities include reviewing case files (court transcripts and district court records); defining issues; drafting briefs, stipulations, dismissals, or motions to withdraw; consulting with other more experienced attorneys to prepare case strategy and arguments; studying, interpreting and applying laws, court decisions and other legal authorities for use in the prepar! ation briefs and motions. Conduct legal research to write the Appellant! âs Opening Brief in meritorious cases. This includes ensuring accurate citation to the record and applicable law; evaluating the strength of issues to narrow and define case strategy; consulting with trial counsel and senior attorneys where necessary; soliciting feedback from peers; and drafting, reviewing, and revising legal arguments according to the standards established by the Montana Supreme Court and internal policy. Determine which issues to raise and argue on appeal. Develop Andersâ briefs in cases where the grounds for appeal are frivolous. Read Attorney Generalâs Response; evaluate responsive arguments and identify which arguments to challenge and which, if, any to concede. Conduct legal research, write short appellant reply brief. Conduct oral argument when the Montana Supreme Court requests. Consult with trial-level public defenders and both trial and appellate contract attorneys representing the agencyâs clients in trial regarding procedural and substan! tive legal questions, including but not limited to questions regarding appellate procedure and original proceedings in the Supreme Court and substantive law.
Competencies:
This position requires knowledge of the concepts and theories of civil and criminal law; Montana and federal constitutional law; pertinent court rules of practice and procedure; appellate legal concepts including rules of construction, standards of review, preservation, plain error review, and ineffective assistance of counsel standards; Montana Rules of Professional Responsibility and ethical duties to the clients and Court; and general knowledge regarding the statutes, standards, and policies regarding the creation and operation of the Office of the State Public Defender. Skills in use of office equipment, court procedures, research, oral presentations, communication, organization, time management, and written communication. The position requires the ability to establish and maintain! effective relationship with others: to communicate effectively verball! y and in writing; to effectively research and analyze documents; able to maintain professionalism when critiqued, and able to develop client relationships.
Education/Experience:
Applicants must hold a J.D. from an ABA accredited law school. Admission to the State Bar of Montana is preferred on the date of hire. Ideal candidates will have a strong desire to work as a public defender and have experience in appellate litigation. Admission to the State Bar of Montana is preferred on the date of hire.
