Duties:
This position is located in the DNRC Legal Unit. Under the general direction of the Chief Legal Counsel and in coordination with other DNRC counsel, the incumbent provides legal advice, review, and representation in state and federal courts to the divisions of the DNRC, director, and the Board of Land Commissioners in areas of sovereign waters and land, including title and management of land resources. This position will provide legal advice and representation to DNRC primarily in areas of real estate management, including commercial leases, cabin and home site leases, sales, exchanges, grants of rights-of-way and easements, prescriptive roads, subdivision review, water law, zoning, environmental and regulatory issues, and complex real estate titles relating to State trust lands. Incumbent assures agency compliance with the administrative laws of the state and all applicable federal and st! ate constitutional requirements in implementation of the agencyâs statutory duties in all administrative forums. As part of a real estate management team, the Incumbent reviews and prepares documents to implement the specific purposes of complex real estate transactions, and may, in coordination with land managers, help negotiate the form of documents necessary to achieve the departmentâs goals.
Some travel is required.
Competencies:
The following knowledge, skills, and abilities are required to fulfill the duties of this Lawyer position: A Juris Doctorate degree from an accredited law school with course work in constitutional, natural resource, commercial, real property and administrative law and two years of experience as a licensed attorney.
Knowledge of legal research methods and techniques; negotiating techniques; court and administrative hearing processes, procedures and rules: administrative, mineral, natural resource, and pr! operty statutory and case law; laws and rules administered by the DNRC.! Specific experience as a real estate legal practitioner, including experience in curing defects in titles, drafting real estate documents, and litigating land titles specifically relating to leases, sales, exchanges, conveyances, covenants, and easements is preferred. Knowledge and experience relating to State trust land is also preferred.
Ability to establish and maintain effective working relationships with others; to communicate effectively verbally and in writing; to conduct legal research and investigations, analyze facts and circumstances to identify critical elements and draw conclusions based on the application of the law and recognize issues of public policy that must be decided by higher authority; to act with initiative, good judgment and tact; and to organize and prioritize work and manage time effectively.
Skill in the use of desktop software including Word, Excel, Powerpoint, and legal research applications.
A valid driverâs licen! se is required.
Education/Experience:
The required knowledge, skills, and abilities are typically acquired through a Juris Doctorate degree from an accredited law school with course work in constitutional, natural resource, property, and administrative law and two years of job-related experience.
