    The successful applicant must receive positive job references. Pay for employees new to DLI will be set at a level below salary of current employees with similar qualifications.     Requires sitting for long periods of times and extended typing on a keyboard. Some bending, stooping, and carrying are required, usually with respect to filing and transporting files. Lifting may involve 35 pounds or more occasionally.

    Must be able to travel in vehicles for long distances with Court staff in order to attend out-of-town trials/hearings. This position also necessitates the ability to drive, travel, and spend intermittent nights out-of-town.

    Duties:
    Prepare for and attend the trial proceedings as the assisting clerk to the Judge and law clerk. Perform final proofreading of decisions and procedural and substantive orders, verify references to the record, citations, and quotations. Analyze and evaluate legal decisions, documents, and correspondence in complex cases to ensure all applicable statutory and Court requirements are met. Perform legal research of factual and legal issues utilizing legal research techniques and internet search data bases such as the Court’s web-based topics index search engine, WestLaw, Montana Code Annotated, Administrative Rules of Montana, Montana Reports, and Larson’s Workers’ Compensation Law, as well as utilizes the Court’s Standard Operating Procedure handbook and the Bluebook citation manual.

    Publish issued decis! ions with the State Law Library and electronically copy all substantive! orders and decisions to the parties of record as well as to the appropriate parties at the Department of Labor and Industry, the State Reporter, and other interested parties.

    Schedule and participate in the Court’s rules committee meetings and participate in administrative rule preparation in preparing amendments to the Court’s Rules. Review and edit proposed rules, amendments, and responses to proposed Court rule changes to ensure proper format, grammar, and phraseology as required by MAPA or any other guideline. Prepare notices and orders for publication in the Montana Administrative Rules.

    Act as pretrial hearing examiner. Review and analyze each file, and preside over on-going trial management with the parties, field procedural inquiries, mediate disputes, and issue rulings on pre-trial issues not formally moved by motion. Issue orders concerning discovery, scheduling, and procedural matters and disputes, and submit detailed memorandums summarizin! g the same to the Judge and law clerks.

    Maintain complex common fund cases, each comprised of between 10 and upwards of 600 Respondent insurance companies. Compose and maintain Excel spreadsheets for tracking and disposition purposes. Maintain a system of service of filed documents whereby the entire docket is uploaded onto the Court’s website with links to each document filed.

    Act as backup for payroll functions. Act as the information technology manager. Liaison with the Department of Labor and Industry with respect to computer information and problems. Troubleshoot simple computer problems for coworkers. Oversee in-office installation of computer programs and updates, including legal research programs, by acting as liaison between the Court and research institutes. Maintain the Court’s law library.

    Using the Court’s Oracle case management system for statistical purposes track case type, issue count, jurisdiction count, plan count, number ! of cases opened and closed, decisions issued and their type, trials hel! d, settlement conferences held and results, and full and final compromise settlements submitted. Compile statistics for each fiscal year using a combination of reports from the Court’s Oracle case management system and Word and Excel tables compiled manually throughout the year, publish the statistical reports on the Court’s web site, and provide the statistical reports to the Governor’s Office, Legislature, other interested state departments, as well as workers’ compensation research institutes, as requested. During legislative sessions, track bills which may impact the Court.

    Competencies:
    Work involves a full range of Court Clerk duties by performing legal, administrative, and clerical work in support of the Court’s office operations; acting as an assistant to the Judge at trial; administering oaths to witnesses; ensuring that all legal documents and related materials are processed and documented accurately within established timelines and l! egal parameters; preparing a docket of cases for trial; securing information for the Judge, other members of the staff, and the public; identifying and responding to the Judge’s inquiries in a timely and efficient manner; contacting attorneys and pro sé litigants to obtain information for the WCC; and responding to questions about procedural issues concerning cases and legal actions. In addition, this position functions as a Pretrial Hearing Examiner, performing legal, administrative, and clerical tasks.

    Education/Experience:
    The above knowledge, skills and abilities are typically acquired through four years of college or technical course work and one (1) year of administrative work experience, or any relevant combination of education and experience equivalent to five (5) years.
