Duties:
This position is responsible for providing the full scope of legal representation on behalf of quasi-judicial medical, technical and professional licensing boards assigned to the Business Standards Division of the Montana Department of Labor and Industry. This position may be assigned work for the other Divisions in the Department as needed. Couns! el is responsible for advising boards and the Department concerning all legal issues involved in their decisions and performs all related legal duties for the licensing board staff. Duties include litigation of licensing and disciplinary actions, training, drafting legislation and advising boards regarding statutory obligations, policies and proper exercise of quasi-judicial and legislative authority as an executive branch agency of state government. Duties also include litigation of injunctive actions against the unlicensed practice of the profession on behalf of the assigned boards. Position must work with the public when explaining and interpreting professional licensing law.
Competencies:
Requires knowledge of: Litigation; legal research methods and techniques; administrative, judicial, and legislative processes; state and federal statutes, case law and constitution provisions pertinent to Department programs and functions; rules, policies and! procedures of Department.
Requires knowledge of: Agenc! y organizational structure, functional relationships, goals and objectives. Agency terminology, principles and practices.
Requires teamwork, communication (verbal and written), and perseverance. Requires creativity for handling new and unique problems and requires the ability to analyze large quantities of complex information and draw conclusion and make recommendations that are practical.
This position requires travel statewide and occasional assignments out of state. A valid driverâs license is necessary. Incumbent must be capable of working under a heavy workload and be capable of meeting the demands from numerous sources and stressful conditions.
Education/Experience:
This position requires a Juris Doctorate degree from an accredited school of law and admittance to the Montana Bar and Federal District Courts as well as required qualifications to be appointed a Special Assistant Attorney General and Special Deputy County Attorney. !
