Provide insurance litigation prosecution and defense in all claims related legal forums. Provides and legal advice and training to Montana State Fund management and teams
Duties:
Represents Montana State Fund before various legal forums, including administrative agencies, the workers' compensation court, district courts, and the Montana Supreme Court. Claims attorneys are responsible for their own litigation caseloads requiring fact investigation, legal research, development of theory and strategy for defense of case, writing and filing all legal documents, discovery, depositions, briefs, examination of witnesses, oral arguments, settlement conferences and analysis of lega! l implications of the outcome of the litigated case. Case load includes complex litigation matters often involving constitutional questions that have broad system wide impact with high dollar values. Legal work is conducted in a largely independent manner with only general oversight. Frequent travel to the various venues of the Workers' Compensation Court is required.
Interprets statues, court decisions, administrative rules and policies concerning or affecting the organization and provides written and oral legal advice and recommendations to management and staff on a daily basis; researches and responds to requests for information and ensures effective service levels are met in support of the multifunctional teams; develops and presents legal training to core business functions and other personnel on statutes, regulations, cases and legal implications of establishing or changing policies or procedures.

Educa! tion/Experience:
Juris Doctorate degree plus five years of prog! ressively responsible work experience as an attorney. Other combinations of education and experience that could provide the equivalent knowledge, skills and abilities will be evaluated and considered. Licensed to practice law in the State of Montana. Workers' compensation litigation experience and relevant designations and certifications preferred.
