Duties:
This position is legal counsel for the PER Board, a constitutionally empowered authority. This position provides comprehensive legal services on complex legal issues to the PER Board and MPERA management, under the s! upervision of a chief legal counsel. This position will be responsible ! for the majority of the MPERA’s and the Board’s litigation â€"related duties, The position independently provides legal advice to MPERA staff on issues involving established legal precedent and procedure. This position has fiduciary duties to retirement system participants, which requires judgment and action independent of the PER Board. As legal counsel for the Public Employees' Retirement Board, this attorney must have or develop thorough knowledge of federal and state statutes and regulations controlling nine distinct public employee retirement pension systems and the deferred compensation plan.

Competencies:
  • Working knowledge or ability to learn:
o The conduct of state and federal administrative proceedings under the Montana and federal Administrative Procedures Act, Attorney General's Model Rules, and PER Board policies and regulations.

o State statutes and regulations governing the Montana Public Employees', Judges'! , Highway Patrol Officers', Sheriffs', Municipal Police Officers', Firefighters' Unified, and Game Wardens Retirement Systems, the Volunteer Firefighters' Compensation Act, and Deferred Compensation Act.

o Montana contract law and principles of equity, particularly as applied to retirement systems and pension trust fund administration.

o Actuarial principles.

  • Ability to perform in-depth legal research.
  • Knowledge of state and federal constitutional provisions relating to pension trust funds, equal protection, due process, contractual impairment by governmental agencies, and right to know/right of privacy.
  • Working knowledge of state and federal civil court litigation, including courtroom practice and procedure, discovery techniques, Montana and Federal Rules of Civil and Appellate Procedure, Montana and Federal Uniform District Court Rules, and Montana and Federal Rules of Evidence.
  • Working knowledge of retirement! or social security disability considerations in pensions.
  • Kno! wledge of federal retirement laws and regulations, including ERISA.
  • Knowledge of federal ADA and ADEA statutes and regulations.
Education/Experience:
The above knowledge, skills, and abilities are typically acquired through a Juris Doctor from an ABA accredited law school and three years of progressively responsible experience in the practice of law, including at least two years of litigation involving administrative law, disability determinations, or contract issues. Experience with contested case appeals, judicial appeals, public pension law, and the administrative rule process is desirable.
