Job Overview: This position is responsible for providing legal support to and representation for the Department of Public Health and Human Services.
Major Duties or Responsibilities:
Client Legal Support
  • Responds to requests for legal research and options of legal questions within the Department, and provides verbal and written legal opinions
  • Represents the department in judicial or administrative proceedings.
  • Reviews contracts or other agreements and negotiates with entities who provide services to the Department.
  • Assists in the administrative rule review process, providing technical and legal support for the rule implementation and change process.
  • Provides legal review and assistance in the development and/or review of Department policies and procedures.
    < li>Supports the department in the legislative process, including drafting legislation, and reviewing and providing advice on the impact of proposed legislation on the Department, and providing testimony to the legislature.
  • Directs the work of support staff as necessary to meet the legal needs of clients.
  • Provides training to department staff on relevant legal issues as necessary.
Physical and Environmental Demands:
The majority of work occurs in a typical office environment. Extensive keyboarding and computer use is required.
Knowledge, Skills and Abilities (Behaviors):
Required for the first day of work:
  • Knowledge of legal analysis principles, practices and theories.
  • Knowledge of legal research methods and techniques, including use of LEXIS, Westlaw, and the internet.
  • Ability to analyze difficult legal problems and synthesize a course of action.
  • Ability to maintain a positive, cordial, and effective relationship with co-workers throughout the Department.
  • Ability to develop a level of confidence between themselves and legal clients.
  • Advanced skill in written and oral communication.
  • Ability to use a personal computer, various software programs, and standard office equipment necessary to perform the functions of the position.
Qualifications:
Required Minimum Education and Experience:
  • Juris Doctorate (J.D.) from an accredited law school.
  • Admitted to practice law in Montana.
  • Three years of legal experience.
Preferred:
  • Knowledge of healthcare law.
  • Knowledge of the legislative process.
  • Knowledge of administrative review procedures, all aspects of the Monta na Administrative Procedures Act (MAPA), and judicial review procedures.

Training Assignment: This agency may use a training assignment. Employees in training assignments may be paid below the base pay established by the agency pay rules. Conditions of the training assignment will be stated in writing at the time of hire.
